Return & Refund Policy (Right of Withdrawal)

1. Right of Withdrawal

We want you to be completely happy with your new artwork. EU & International Customers: We voluntarily grant the statutory 14-day right of withdrawal to all our collectors worldwide. You have the right to withdraw from this contract within 14 days from the day on which you (or a designated third party) acquire physical possession of the goods.

To exercise this right, you must inform us of your decision via email before the 14-day period expires.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

You can use the below model withdrawal form for this purpose, but it is not mandatory to use it.

2. Effects of Withdrawal (Refunds) & Currency

If you withdraw from this contract, we shall reimburse to you all payments received from you for the artwork itself

Standard Shipping Costs: We refund the original outbound standard shipping cost for the cheapest delivery method offered for EU countries only.
Processing Time: We will issue the refund no later than 14 days after we receive the returned goods.
Payment Method: Refunds are issued to the original payment method.
Currency Disclaimer: All refunds are processed in EUR (€). If your credit card is in another currency (e.g., USD, GBP), the exact amount refunded may vary slightly due to your bank’s exchange rates and fees. These variations are outside our control.

3. Returning the Goods

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

Cost of Return: You will have to bear the direct cost of returning the goods. For high-value artworks, we strongly recommend using a trackable shipping service and purchasing shipping insurance. We cannot guarantee that we will receive your returned item, and you are responsible for the artwork until it arrives at our studio.

Condition of Goods: You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Please Note: We request that you return artworks in their original packaging (tube or box) to ensure they are not damaged in transit. If the artwork is returned damaged due to poor packaging on your part, the loss in value may be deducted from your refund.

4. International Returns & Customs Duties

Please read carefully if you are returning from outside the EU (e.g., USA, UK, Switzerland):

Return Shipping Costs: The customer bears the direct cost of returning the goods. International return shipping can be expensive. We strongly recommend using a courier (FedEx/UPS/DHL) with tracking and insurance, as you are responsible for the artwork until it reaches our studio safely.
Non-Refundable Duties: Import duties, taxes, and customs fees collected by your country’s government upon delivery are non-refundable by us. You may be able to reclaim these from your local customs authority directly, but we cannot assist with this process.
Customs Declaration for Returns: To avoid delays or import taxes when the artwork re-enters Germany, you must clearly mark the package and customs documents with the phrase: "RETURNED GOODS - FAILED SALE - NO COMMERCIAL VALUE" If you fail to mark the package correctly and we are charged import duties to receive the return, these costs will be deducted from your refund.

5. Damaged in Transit

We take great care in packaging our art. However, accidents can happen.

Inspect upon Arrival: If the package arrives visibly damaged, please take photos of the box before opening it and, if possible, draw up a damage report with the courier immediately.
Report Issues: Contact us at hello@ellen-paintings.art within 48 hours of delivery with photos of the damage. We will arrange for a replacement, repair, or full refund depending on the situation and handle the insurance claim with the carrier.
Resolution: We will arrange for a return, repair, or full refund and handle the insurance claim with the courier.

6. Exceptions to the right of withdrawal (Non-Returnable Items)

Following items are non-returnable:

Commissioned / Custom Art: The supply of goods made to the consumer’s specifications or clearly personalized (e.g., a painting created specifically for you on commission).
Unsealed Sealed Goods: The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Gift Cards: Gift cards are non-refundable.

To complete your return, we require a receipt or proof of purchase.

7. Sale Items

Our standard cancellation rights apply to sale items. In accordance with EU consumer protection laws, the 14-day right of withdrawal remains valid for discounted items, provided they are not custom-made.
