1.1. These General Terms and Conditions (GTC/AGB) govern the relationship between Rave Painter's Shop UG, Hauptstraße 194, 79739 Schwörstadt, Germany (the "Vendor") and the customer (the "Customer") for all orders placed through the online shop.
1.2. A "Consumer" is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (B2C).
1.3. Deviating terms from the Customer will not be recognized unless the Vendor expressly consents in writing.
2.1. Product displays in the online shop are invitations to place an order and do not constitute a legally binding offer.
2.2. Artistic Disclaimer: Original artworks are unique. Product images and colors are indicative; slight variations in color or texture between the digital display and the physical artwork are technically inevitable and do not constitute a defect.
2.3. All offers are valid "while stocks last" unless stated otherwise.
3.1. The Order: By clicking "Place Order," the Customer makes a binding request to purchase.
3.2. Conclusion: A binding contract is concluded only when the Vendor confirms dispatch via email or dispatches the goods. For "Prepayment," the contract is concluded upon receipt of bank details; payment is due within 10 days.
3.3. Refusal of Orders: The Vendor reserves the right to refuse orders due to unclear contact details, payment authorization failure, or if goods are out of stock. If out of stock, the Customer will be offered a choice between waiting or a full refund.
3.4. Technical Errors: In cases of obvious pricing errors (e.g., €2 listed instead of €2,000), the Vendor reserves the right to void the transaction and refund the Customer.

4.1. All artworks, digital images, and website content are the sole property of Elena Popa Paintings and protected by copyright law. Purchase of a physical painting does not transfer copyright. The Customer may not reproduce or commercially exploit the artwork image without an additional licensing agreement.
4.2. User Content: Users may upload photos/videos for reviews. You grant the Vendor a non-exclusive, royalty-free license to use these for marketing. You are prohibited from posting unlawful, obscene, or defamatory material.
4.3. Feedback: Any suggestions or comments (excluding personal data) sent to the Vendor are treated as non-confidential and may be used for business improvement without compensation.
5.1. Prices do not include statutory German VAT. VAT will be calculated based on the shipping address and will show in the shopping cart. Shipping costs are displayed prior to final order placement..

5.3. International Orders (Non-EU): For deliveries outside the EU (e.g., USA, UK, Switzerland), the Customer is the "Importer of Record." The Customer is solely responsible for all import duties and local taxes. These are not included in the checkout price and are typically invoiced by the courier (DHL/UPS/FedEx) upon arrival.
6.1. Full payment via Credit Card, PayPal, or Bank Transfer is required before dispatch.
6.2. Eligibility: The Customer must be at least 18 years old and provide accurate, up-to-date information.

7.1. We ship to the countries explicitly listed on our Shipping Page. Delivery to PO boxes is not possible.

8.1. Consumers (B2C) have a statutory 14-day right of withdrawal.
8.2. Exercise: The Customer must notify the Vendor (Rave Painter's Shop UG, Hauptstraße 194, 79739 Schwörstadt, Germany; hello@ellen-paintings.art) via a clear statement according to the Cancellation Policy.
8.3. Exceptions: The right of withdrawal does not apply to:

9.3. Liability: The Vendor’s liability is limited to typical, foreseeable damage. Liability for gross negligence or intent remains unaffected.
9.4. The goods offered in stores are new and original. Elena Popa Paintings is liable for defects in the goods based on applicable law. Elena Popa Paintings also complies with the legal guarantee for good conformity.
9.5. Elena Popa Paintings will take measures to fully ensure the proper functioning of the Store, in the areas indicated by current technical knowledge and undertakes to remove within a reasonable time all shortcomings reported by the customers.
9.6. External Links: The Vendor is not responsible for the content of third-party websites linked on the Store.
10.1. The goods remain the property of Rave Painter's Shop UG until full payment of the purchase price is received.
11.1. Eligibility: By using this Site, you represent that you are at least 18 years of age and possess the legal capacity to enter into binding contracts.
11.2. Account Security: If you create an account, you are responsible for maintaining the confidentiality of your password and account details. You agree to accept responsibility for all activities that occur under your account.
11.3. Prohibited Conduct: You agree not to use the shop for any unlawful purpose, including but not limited to:
12.1. The Store records the orders electronically. The customers can access the own archived orders for which the customers have been a Contracting Party by contacting the customer service by email at hello@ellen-paintings.art.

12.3. The vendor will also send the customer an order confirmation containing all order data to the email address provided by the customer. In addition, the customer will receive a copy of the vendor's general terms and conditions (including the vendor's cancellation policy and information on shipping costs and the vendor's terms of shipping and payment) along with the order confirmation or upon delivery of the goods at the latest. The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
8.4. Place of Jurisdiction: If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship shall be the Seller's place of business.
8.5. Severability Clause: Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
8.6. Contract Language: The original language of this contract is German. In the event of any discrepancies between the German version and a translated version, the German text shall prevail.
